Finally, the Triple Talaq bill got the green signal from the upper house of India. This contentious bill was passed with the 99 votes in favour and 84 in against. Well, the Muslim Women (Protection of Rights on Marriage) Bill 2019 or the Triple Talaq Bill was passed in the lower house on 25th July and now waiting for the signatory of the President for the final assent.
The bill seeks to make the practices of instant Triple Talaq an offence in India in which a Muslim man used to give his wife a divorce by pronouncing the word Talaq thrice in verbal or written forms. With the rise of technology, this illegal practice also got momentum due to telephone, text messages etc. According to the bill, the man who did this offence will be punished with imprisonment up to 3 years also have to provide subsistence allowances to his wife and children.
Well, the bill was formulated first in the previous tenure of Modi in August 2017 and on 28th December 2017, it was passed in Lok Sabha. That time it was not approved in Rajya Sabha, but luckily this time it is passed with a majority of 99 votes and only waiting for the President’s assent.
Know the provisions of Triple Talaq Bill
- The declaration of Talaq by pronouncing it thrice by verbal, written or technological mode will be considered void and illegal.
- Instant Talaq practice will remain as a cognizable offence where a man will be punished with imprisonment up to 3 years and a fine. The amount of the fine will be decided at the discretion of the magistrate after hearing the case.
- The offence will be considered cognizable only when if the information is provided by the wife herself or her blood relatives.
- Instant triple Talaq offence is non-bailable. However, the bill contains a man can be granted bail if the wife applies for it and the magistrate is satisfied.
- Wife should be given the survival allowances and the magistrate will declare the amount.
- Wife also has a right to seek custody for her children from the marriage and the custody manner will be decided by the magistrate
- Magistrate can compound (i.e. the legal proceedings halted) the case upon the request of the wife of the accused.
However, still the opposition parties are against the bill but the majority of the votes has finally given the approval to the bill.
