All the speculations and rumours going on in Jammu and Kashmir have now come to a halt. Modi Govt. has taken a historic and unprecedented decision on the special status given to Jammu and Kashmir. Today i.e. 05th August 2019 will be remembered always in history. On Monday 5 August, Home Minister Amit Shah presented the two important resolutions in the Rajya Sabha. The resolution includes the removal of Article 370 from J&K and division of J&K and Ladakh into two separate parts. Both are the Union Territories where Jammu and Kashmir will have its own legislature and Ladakh will not have any assembly
Resolution presented in Rajya Sabha
Amit Shah presented a resolution in the Rajya Sabha on Monday. In this resolution, he said that not all sections of Article 370 will be applicable in Jammu and Kashmir. He said in the upper house “Sir, I submit the resolution that this House recommends the following schedules to be issued by the President of India under Article 370 (3). Article 370 Section 1 of the Constitution of India under Article 370 (3) of the Constitution Using the powers conferred by clause 3 of Article 370 read with, on the recommendation of the Parliament’s President, declare that the date on which the signatory will be done on the manifesto by the President and published in the official gadget. From that day all the clauses of Article 370 will not be applicable, except clause 1”.
In one statement of Amit Shah, he said that the people of Ladakh are demanding from a long time, that Ladakh will be registered as the Union Territory, so that the people living here can pursue their goals. Now the status of a union territory has been given to it but will there not be an assembly here. According to the report, Jammu and Kashmir have been given a separate Union Territory status. There will be assembly in Jammu and Kashmir like Delhi, the capital of the country.
Extreme opposition of the leader in Rajya Sabha on the Home Minister’s resolution
This historic victory has to go through the extreme opposition of the parties in Rajya Sabha. When Amit Shah introduced a proposal to remove Article 370 of the Constitution, then all the opposition parties sitting in the house started creating a ruckus. After the announcement of Home Minister, there was a fierce uproar on this issue in the Rajya Sabha. The PDP MPs clung their clothes and started making a noise. Even the top parties like Congress TMC and DMK MPs made a lot of publicity of this announcement of the government. “BJP has killed the Constitution,” Congress MP Ghulam Nabi Azad said.
PDP chief and former Jammu and Kashmir chief minister Mehbooba Mufti expressed her apprehensions in a tweet. “GOIs intention is clear & sinister. They want to change demography of the only Muslim majority state in India, disempower Muslims to the extent where they become second class citizens in their own state,” she said.
Home minister declared the concept of Article-370 wrong
In the midst of this extreme opposition, Amit Shah also declared the concept of Article 370 wrong. It is believed that Article 370 is only the reason for J&K to be a part of India. It was only signed due to the merger letter of Jammu & Kashmir and India in 1947. The Home Minister also said that no decision has been taken in the past due to vote bank, but we have our will power and we do not care about vote bank. Amit Shah said that they should even do a delay of second in the removal of Article 370. Amit Shah said that he is ready for a debate on this issue.
