Court approve appeal for removal of Mosque near Krishna janmabhoomi

A court of Mathura agreed to listen to the appeal for the removal of a mosque constructed during the 17th century situated right next to Krishna Janmabhoomi Temple of the city. The court has released a notice to all of the stakeholders including the trust of “Shahi Idgah” Mosque and “Sunni Waqf Board” to be present in the court on November 18.

Before this month, a group of some people filed a lawsuit in the court under the Senior division civil judge in Mathura district. The suit claims that the mosque was built on the “Lord Krishna’s” birthplace within the 13.37-acre area of “Katra Keshav Dev” temple. But when the senior division civil judge refused the appeal on 30th September, they submit the appeal to the district court on October 12.

After assembling the records from the lower court, the District & Session Court judge Sadhana Thakur admitted the appeal on Friday. “The application stated that if the property of the divinity has been misused, the devotee has got every right to litigate perpetrators. It was also submitted to the court that the five-judge bench in the Ayodhya case. It states that a worshipper has a right to protect the property of the numen” counsel for the petitioners, Vishnu Shankar Jain told a news agency.

The lawsuit was filed in the name of the child divinity Lord Krishna, through the “next friend” Ranjana Agnihotri and others.

The district court released a notice on Friday to all the parties involved including Management and Committee of Shahi Idgah Mosque Trust, Sunni Central Waqf Board, listed as the defendants of the suit.

The applicants seek an order directing the Masjid authorities to remove the constructed monument lifted by them trespassing over the land that falls under the area of “Katra Keshav Dev Temple”.

The application also mentioned that the “Shri Krishna Janmabhoomi Seva Sansthan” entered into an illicit contract with Shahi Idgah Trust with the purpose of grabbing the land. In the year 1973, a civil judge of Mathura passed judgment on the claimed compromise between the Shahi Idgah Trust and Shri Krishna Janmabhoomi Seva Sansthan. The verdict restricted any modifications to the constructed structures. The present filed case demanded the judgment be canceled.
